Undoubtedly, the subject of the reform has left all companies with questions about how outsourcing will be carried out and what modifications were made with the reform.

 

In order to achieve this reform, terms that did not favor the development and welfare of workers were modified, among them:

 

– The disappearance of the term outsourcing or labor subcontracting.

– The labor intermediary is redefined, which means that companies can provide services for the search of personnel, but the contract must be signed directly with the company.

– Only the outsourcing of specialized services is allowed, as long as they are not part of the corporate purpose.

– Companies offering specialized services must apply to the Secretary of Labor and Social Welfare.

– Regarding profits, it is limited to the greater of the average of the last 3 years or 3 months of salary.

– Another important aspect is that those companies that incur in labor subcontracting will be subject to a fine ranging from $179,000 to $4,500,000 Mexican Pesos.

 

Therefore, the outsourcing of specialized services is allowed, as long as it is not part of the corporate purpose and economic activity of the company that is outsourcing the service.
